Part 1- Classified Advertisement Service Terms

1. MEANINGS AND DEFINITIONS

“Online Classified Advertisement Service ” means the services explain in the paragraph 3 of this Part 1, which will be rendered to you by Wirecost Online Classified Adverisment Trading(WOCAT)

“SALEABLE ITEM OR SERVICE” means items that are in good condition or service level provided and is acceptable or in accordance to the expectations of the buyer as describe in the online classified advert post by either a private seller or a business.

“Principal” shall mean the individual seller or buyer party that is covered by our money back guarantee.

"Buyer" shall means an individual or business who visit Wirecost website for the purpose of buying and obtaining products and services enlisted on the platform.

“Seller or Service Contractor” shall also mean a trusted private individual(s) or business who freely enlist their saleable products or service on our classified ads platform.

“WIRECOST” shall mean Wirecost Free Classified Enterprise, a private business trading registered in SPAIN, operating in the United Kingdom.

“WIRECOSTING” shall mean looking for or posting adverts of new or used saleable products on Wirecost website, including contacting buyers or sellers to bid for, request quote or negotiate on the cost price of the ads product of service.

“Wirecost App” shall mean Wireco App, a software application and associated services provided by Wirecost S.C.P to you according to the term of use and conditions detail in Part 2.

 

“Website” is known to be www.wirecost.com, www.wirecost.co.uk and www.wirecost.es

 

2. THE PROVISIONS OF BOOKING BY WIRECOST ENTERPRISE.

Wirecost provides number of online advert placement  services. These wirecost online account opening services including the following:

1. Accepting bidding requested by a potential buyer and user of Wirecost Website and Wireco App,  and this does not deny Wirecost Enterprise’s right at it sole and absolute discretion to decline any such request and/or cancel an accepted an account opening request.
2. Identifying, registered and accepting suitable advert placement and promos on its platform.
3. Keeping appropriate records of profile users, transaction completed through the platform.
4.   Accepting payment on behalf of p[arties involve in the bid, negotiation, buying and selling of items, products or service on the platform.
5. Manage and attend to questions, feedbacks and complaints from both the buyer and seller using Wirecost Website and App platform. This may be made by electronic mail: This email address is being protected from spambots. You need JavaScript enabled to view it. You are implored to give your concerns if any of the posted  adverts do not conform to your satisfaction or raise any fraud suspicion.

As in each cases above, in accordance with the relevant provisions of the Legislation.

Pursuant to, and for the purposes of the Legislation, Wirecost accepts account opening online, acceptance of payment from its operating centres and online platforms and is subject to all statutory and regulatory obligations with respect to that activity of communicating to both the buyer and seller.

   3. PAYMENT

Booking and sign up services are rendered to you by Wirecost Enterprise free of charge with the requirement to pay no account opening fee.  Wirecost Enterprise reserves the right to introduce a fee for the provision of premium service and sign up services. And if Wirecost decides to apply sign up and booking fee, it will inform you and enable you to continue or terminate your access to the booking service on either the website or Wireco App.

There may be updated changes to these rates and services time to time. The onus lie on you to familiarise yourself with the current rate for the protection services.

4.    LIMITATION OF OBLIGATIONS

To the limit allowed by application legislation, Kafterwell Enterprise will not be obliged in any way (whether such arises in contract by way of indemnity or another, tort (including negligence) misrepresentation, breach of statutory safety duty, restitution or otherwise) and for any like theft, loss of your or any other person’s property in connection with the Booking Services or such booking accepted by Wirecost Enterprise:

1. any buying and selling transaction  that has not or yet to be accepted or completed

ii.any loss , damage or costs , expenses or liability that are suffered by another person order than you the principal(s) with the use of our classified ads system.

iii.any losses that could not be genuinely be expected to result from our negligence or breach of these terms and conditions. Any loss because by the negligence of the buyer or seller as a result of saleable product or service level not conform to the principal expectation shall be the main liability of the seller

1. any loss relating to your business, life and property, or the business of the principal or any other person.
2. any loss of friendship, relationship, loss of profits, loss of revenue, loss of opportunity, loss of business or employment(either the loss is reasonably, to an extent, expected to flow from our negligence or breach of these terms and conditions
3. any other loss, damage, cost incurred, expenses and obligated liability that you suffer in connection with the Booking Services, only to the extent that Kafterwell Enterprise fails to fulfil its obligations to you up to the standard of promise and a diligent of the online adverts placement Services.

vii. when Wirecost is found with any negligence of duties in connection to the Booking Services, its obligated liability will be limited to an amount equal and up to £1.

Nothing in these Terms and Conditions will limit ir exclude Kafterwell liability to you for personal injury or death except caused directly by Wirecost Enterprise’s negligence.

 

       5. APPLICABLE LAW

The Advertisement Posting and the Booking Service Terms set out in this Part 1, and all non-contractual obligations arising in any way whatsoever out of or in connection with the Classified Advertisement Service Terms shall be governed by, interpreted and take effect in accordance with the laws of Europe.

Any dispute, claim or case difference arising out of or relating to the Classified Ads Services or Booking Service Terms is subject exclusively to the jurisdiction of the courts of Spain, Eu

 

Part 2- Terms of Use

These Terms of Use apply to your visit to and your use of the website and the Wireco App as well as to all other information, recommendations and/or services provided to you on or through the Website and the App.

 

1. Contractual Relationship

These Terms in Part 2 shall cover the access or use by you, the principal, group, an individual within any country in the world, of applications platform including the Wireco App, websites, content, products and services made available by Wirecost, a trade enterprise business operating in England having its registered office in Spain at Calle Sant Daniel 4 2-1, 08790, Barcelona. Concerning the classified adverts website, it allows you to access the placing of ads either freely or with a premium; of all the resources available on the platform in accordance to Part 1 above.

PLEASE READ THESE TERMS CAREFULLY BEFORE ACCESSING OR USING THE SERVICES.

Your access and use of the Services remains you are in agreement to these Terms, which establishes a contractual relationship between you and Wirecost Enterprise. If you disagree with any of these Terms, you may not access or use the Services. These Terms clearly supersede any prior arrangements with you. Wirecost may end these Terms or any Services as regards to you, or generally cease to offer or exempt your access to the Services or any portion therein, at any time for concluded reason. Wirecost will provide you with as much notice as it duly expected in such termination, denial or exclusion, at latest 24 hours’ notice. However, Wirecost reserves the right to terminate these Terms or any Services with respect to you or generally cease offering including suspend your profile account or exclusive access to the Services or any portion therein, instantly at any time without notice if (a) you are in breach of these Terms, (b) it is not practical to give such notice in the circumstances, or (c) in Wirecost’s opinion, any delay in such termination would expose Wirecost or Third party to significant amount of risk in damages or harm.

 

Wirecost can amend these Terms and supplementary terms at any time. Such amendments will be posted here and any other required place on our Ads platform. And upon access to our Services at the time of the amendments, you shall be consenting to the amended terms.

 

 

When we collect and use your personal information in connection with the Services is as provided in Wirecost Privacy Policy located at https://wirecost.com/legal/privacy. Wirecost may provide to a claims processor or an insurer any necessary information (including your contact information) if there is a complaint, dispute or conflict, which may include a fraud, involving you and a seller or buyer (including service contractor) and such information or data is necessary to resolve the complaint, dispute or conflict.

2. The Services

Wirecost  Online Classified Advert Service constitute a virtual technological platform that allows access for users of Wirecost website and Applications to browse, communicate, bid, review or buy from another person or establish a transactionary relationship with an independent third party or any other private or business users of Wirecost platform.

 

RIGHT TO USE

Subject to your compliance with these Terms, Wirecost grants you a limited, non-exclusive, non-commercial, revocable, non-transferable right to: (i) access and use the website and Applications on your PC and personal device solely in connection with your use of the Services as buyer and seller of product or service; and (ii) access and use any content, information and related materials that may be made available through the Services, in each case solely for your personal, non-commercial use.

On the site, you can place unlimited adverts for free. But promotions and posting of banners and other business  resources on our platform will be subjected to only premium cost. You acknowledge that portions of the Services may be made available under Wirecost various brands or booking options in line with the buying and selling terms of trade, fairness and good dealing with trusted sellers that place ads on the site including the Wirecost Service brands currently referred to as “Wirecost,”.

 

Third Party Services and Content.

The Services may be made available or accessed in connection with third party services and content (including advertising and promo) that Wirecost Enterprise does not control order than placement of premium banner and ads on our platform. You acknowledge that different terms of use and privacy policies may apply to your use of such third party services and content. Wirecost does not endorse such third party services and content and in no event shall Wirecost and its brands be responsible or liable for any products or services of such third party providers. In the case of software application parties like Additionally, Apple Inc., Google, Microsoft Corporation Software, your access to the Services using their installations is subject to terms set forth in the applicable third party beneficiary’s terms of service.

Ownership

Ownership of the Online Advertisement Placement Services, brand and categories shall be an exclusive property of Wirecost Enterprise. Your access to these Services as user or providers shall not mean ownership but your access shall be limited to the terms of the right of use above.

 

3. Your Use of the Wirecost Services

User Accounts

For you to have access to most of the Services, you need to register for and maintain an active updated personal user Services account, either as a provider or purchaser of provider services. You must be at least 18 years of age, and including the legal age considered in your jurisdiction or country of Services delivery. Opening an account demands you to submit certain personal information, such as your name, address,  driver’s permit, Photo ID, mobile phone number, riand age, as well as at least one valid payment method (either a credit card or accepted payment partner). You agree to maintain accurate, complete, and up-to-date information in your Account. Your failure to maintain accurate, complete, and up-to-date Account information, including having an invalid or expired payment method on file, may result in your inability to access and use the Services or Kafterwell’s termination of this Agreement with you. You are responsible for all activity that occurs under your Account, and you agree to maintain the security and secrecy of your Account username and password at all times. Unless otherwise permitted by Wirecost in writing, you may only possess one Account.

 

4. Payment

You agree that the use of the Classified ads platform Services may result in charges to you for the services or goods you receive from a Third Party Provider in using the website  to promote or have access to special information. And we run a review o all post placed on Wirecost site and operate a 1 week back money guarantee protection for all transaction that happen between a buyer and sellers using Wirecost website payment gateway. After you have received services or goods obtained through your use of the Services, Wirecost Enterprise will facilitate your payment of the applicable Charges on behalf of the Third Party Provider as disclosed payment collection agent for the Third Party Provider (as c2c, c2b or b2b).

Payment of the Charges in such manner shall be considered the same as payment made directly by you to the Third Party Provider. Charges will be inclusive of applicable taxes where required by law. Charges paid by you are final and non-refundable, unless otherwise determined by Wirecost. You retain the right to request lower Charges from a Third Party Provider for services or goods received by you from such Third Party Provider at the timey you receive such item or services. 

All Charges are due immediately and payment will be facilitated as soon as practicable by Wirecost using the preferred payment method designated in your Account, after which we will send you a receipt by email confirmation.

TAX LIABILITY

Wirecost Online Advertisement Enterprise shall be responsible for the collection and process of Subscription fee(if applicable) and the Service rate ffrom users of premium advert and promotional materials placement on Wirecost platform(through a third party)whom will have the sole obligation to pay the local tax in their country of jurisdiction. Wirecost will not be liable to pay or repayment of negligence in case of tax evasive on behalf of the seller contractor providing the delivery of the saleable item or service. At all time, all Wirecost service providers will be classified as self employed who shall be liable to pay their tax to their local tax authority in accordance to their issued invoice payment.

5 Disclaimers, Limited of Liability

WIRECOST SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE OR CONSEQUENTIAL DAMAGES, INCLUDING LOST PROFITS, LOST DATA, PERSONAL PROPERTY, PERSONAL INJURY OR PROPERTY DAMAGE RELATED TO, IN CONNECTION WITH, OR OTHERWISE RESULTING FROM ANY USE OF THE SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. WIRECOST SHALL NOT BE LIABLE FOR ANY DAMAGES, LIABILITY OR LOSSES ARISING OUT OF: (i) YOUR USE OF OR RELIANCE ON THE PRODUCT OR SERVICES SOLD BY A SELLER OR BUSINESS THAT FALL SHORT OF EXPECTATIONS OR YOUR INABILITY TO ACCESS OR USE ANY OF THE SERVICES; OR (ii) ANY TRANSACTION OR RELATIONSHIP BETWEEN YOU AND A SELLER OR THIRD PARTY SERVICE CONTRACTOR, EVEN IF WIRECOST HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. WIRECOST SHALL NOT BE LIABLE FOR DELAY OR FAILURE IN PERFORMANCE OR AGREEMENT WITH THE BUYER AND SELLER RESULTING FROM CAUSES BEYOND WIRECOST’S REASONABLE CONTROL.

WIRECOST ONLINE CLASSIFIED ADS SERVICES FOR BUYING AND SELLING NEW OR USED ITEMS AND SERVICE CONTRACTING MAY BE USED BY YOU TO REQUEST, PURCHASE AND SCHEDULE PERSONAL ITEMS, EXCHANGE OF ITEMS, PRODUCTS SELLING OF SERVICES WITH THIRD PARTY PROVIDERS, BUT YOU AGREE THAT WIRECOST HAS NO RESPONSIBILITY TO YOU RELATED TO ANY CLOSE PROTECTION, PROTECTION LOGISTICS, DELIVERY OR SELLING SERVICES PROVIDED TO YOU OR THE PARTY INVOLVE IN THE TRANSACTION ORDER THAN THE MONEY BACK GUARANTEE PROTECTION AS EXPRESSLY SET FORTH IN THESE TERMS.
